Another day, another False Claims Act (FCA) allegation—and this time, it’s a big one.
The U.S. Department of Justice (DOJ) announced a healthcare provider agreed to a settlement exceeding $541 million to resolve allegations that unsupported diagnosis codes were submitted to Medicare Advantage Organizations, resulting in inflated payments from the Medicare program. According to the DOJ, the alleged conduct involved diagnosis codes that lacked sufficient documentation in the medical record or were based on improper record amendments.
While every enforcement action has unique facts, the underlying lesson is familiar: documentation matters. Organizations participating in Medicare Advantage and other federal healthcare programs must ensure that diagnoses are accurate, clinically supported, and properly documented. Coding and documentation practices that appear routine can create significant compliance and financial exposure when appropriate controls are not in place.
This enforcement action also arrives during a period of unprecedented FCA activity. In fiscal year 2025, the Department of Justice reported more than $6.8 billion in False Claims Act settlements and judgments—the highest annual recovery amount in the history of the statute. Healthcare-related matters accounted for over $5.7 billion of those recoveries, demonstrating that healthcare fraud enforcement remains a top government priority.
For healthcare organizations, the takeaway is clear: compliance programs cannot be static.
